This Privacy Policy describes how Earnworthy, LLC ("Earnworthy," "we," "us," or "our") collects, uses, and discloses your information when you interact with any part of our services, including Earnworthy Multiply (training and community), Earnworthy Amplify (software), and Earnworthy Agency (done-for-you marketing services), through our website at earnworthy.com or affiliated platforms (the "Service").

By using the Service, you agree to this Privacy Policy and consent to the collection and use of your information as described here. This Privacy Policy should be read together with our Terms & Conditions at earnworthy.com/terms.

1. Definitions

  • Account: A unique profile created for you to access or use our Service.
  • Business: Earnworthy, LLC, which determines the purposes and means of processing Personal Data collected through the Service.
  • Cookies: Small files stored on your device to track usage and improve your experience.
  • Customer Data: Personal information belonging to the customers, leads, and contacts of our clients, which clients upload to or collect through the Amplify platform.
  • Device: Any internet-connected device such as a phone, tablet, or computer.
  • Personal Data: Any information that can identify you directly or indirectly.
  • Service: The website located at earnworthy.com and the Earnworthy Multiply, Amplify, and Agency offerings.
  • Service Provider: Third parties who perform tasks on our behalf (e.g., analytics, hosting, payments, messaging).
  • Usage Data: Automatically collected data, such as IP address, browser type, and pages visited.
  • User/You: The individual accessing or using the Service.

2. Information We Collect

a. Personal Data

We collect information you provide directly, including:

  • Name
  • Email address
  • Phone number
  • Address
  • Company name
  • Payment and billing information (processed via Stripe)
  • Information you submit through forms, onboarding, support requests, or community participation

b. Usage Data

Collected automatically when using the Service, this may include:

  • IP address
  • Browser type and version
  • Device identifiers
  • Operating system
  • Pages visited and time spent on them
  • Referral sources
  • Diagnostics data

c. Customer Data (Amplify Clients)

If you are an Amplify or Agency client, you may upload or collect personal information about your own customers, leads, and contacts within the platform. That information is Customer Data. Your business is the controller of Customer Data, and Earnworthy processes it on your behalf to provide the Service. Your customers should direct privacy questions and requests to you, and you are responsible for maintaining your own privacy policy and consent practices as described in our Terms & Conditions.

3. SMS/Text Messaging & Mobile Information

If you opt in to receive text messages from Earnworthy:

  • You will receive messages related to your account, services, appointments, and, where you have consented, marketing and promotional content.
  • Message frequency varies. Message and data rates may apply.
  • You can opt out at any time by replying STOP to any message. Reply HELP for assistance or contact us at hello@earnworthy.com.
  • Consent to receive text messages is not a condition of any purchase.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging opt-in data and consent will not be shared with or sold to any third party. We share mobile information only with service providers (such as our messaging platform and carriers) as necessary to deliver messages you have requested, and only for that purpose.

4. How We Use Your Data

We use your information to:

  • Provide and improve the Service
  • Process transactions and send related notices
  • Respond to inquiries and provide customer support
  • Send marketing and promotional content (with opt-out options)
  • Deliver text messages and calls you have consented to receive
  • Analyze usage trends and improve functionality
  • Detect, prevent, and address technical, security, and compliance issues
  • Comply with legal obligations

We do not sell your Personal Data.

5. AI Features

Parts of the Service use AI to generate content, suggest responses, and automate conversations. Information you or your contacts submit through AI features is processed to deliver those features. We do not use your Customer Data to train publicly available AI models.

6. Legal Basis for Processing (GDPR)

If you are located in the EEA or UK, we process your Personal Data based on:

  • Consent: You gave clear consent for processing.
  • Contract: Processing is necessary to fulfill a contract with you.
  • Legal Obligations: We are legally required to process the data.
  • Legitimate Interests: To operate, secure, and improve our business.

7. Disclosure of Your Data

Your data may be shared:

  • With Service Providers: Companies that help us run the Service, including Stripe (payments), HighLevel (platform infrastructure), Twilio and telecommunications carriers (messaging and calls), Google (analytics and advertising), and Meta (advertising). Service Providers may use your data only to perform services for us.
  • For Business Transfers: If we are involved in a merger, acquisition, or asset sale.
  • With Affiliates: Our affiliated companies and partners, under this same Policy.
  • For Legal Compliance: To respond to lawful requests from public authorities, enforce our Terms, or protect rights, safety, and property.
  • With Your Consent: For other purposes you authorize.

Text messaging opt-in data is excluded from all marketing-related sharing as described in Section 3.

8. Cookies, Tracking & Behavioral Advertising

We use cookies and similar technologies to operate the Service, remember preferences, and measure performance. We may use platforms like Google Ads, Meta Ads, and others for remarketing.

You can also control cookies through your browser settings. Disabling cookies may limit some features of the Service.

Do Not Track. No uniform industry standard for responding to Do Not Track signals currently exists, so the Service does not respond to DNT browser signals.

9. Data Retention

We retain your data only as long as necessary for the purposes set out in this Policy or as required by law. For Amplify accounts, user data and communications may be permanently deleted 14 days after account closure, as described in our Terms & Conditions. Export any data you need before canceling. We may retain limited billing and compliance records after account closure as required by law.

10. Data Security

We use commercially reasonable measures to protect your data. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

11. Your Rights

Depending on your location, you may have the right to:

  • Access your data
  • Correct or update inaccurate data
  • Delete your data
  • Restrict or object to certain uses
  • Request portability of your data
  • Withdraw consent where processing is based on consent

To exercise these rights, contact us at hello@earnworthy.com. We will verify your identity before acting on a request. We will not discriminate against you for exercising your rights.

US State Privacy Rights. If you live in a state with a consumer privacy law, you may have additional rights, including the right to know what categories of personal information we collect and the right to opt out of targeted advertising. Submit requests to hello@earnworthy.com.

A note for customers of our clients. If your information was collected by a business that uses Earnworthy Amplify, that business controls your data. Direct your request to them, and we will support their response as their service provider.

12. Children's Privacy

The Service is intended for business use by adults. We do not knowingly collect Personal Data from anyone under 18. If you believe a minor has provided us with Personal Data, contact us immediately and we will delete it.

13. International Users

Earnworthy operates from the United States, and your data is processed and stored in the United States. If you access the Service from outside the US, you consent to the transfer of your data to the US, which may have different data protection laws than your location.

14. Updates to This Policy

We may revise this Privacy Policy from time to time. Updates will be posted on this page with a new effective date, and we will notify you of material changes by email or in-product notice. Continued use of the Service after an update means you accept the revised Policy.
